As of l a s t games, when touching an enemy outside battlefield, Mario (Luigi, the Baby bros or Bowser) will engage into battle. There are 5 options, Jump, Hammer, Special Attacks, Items and Flee. As of last Mario and Luigi games, in a battle with a boss or sub boss, you can't flee.
