:I assume the reasoning here is to prefer renders wherever possible. In my eyes, wanting to use the default outfit for a character feels akin to wanting them represented on the Standard Kart: certainly sensible for consistency, and in a perfect world where every setup had a render, it would be preferred. But only some of these have renders, and so the highest-quality artwork (and also the artwork that was chosen by Nintendo to be representative of the game, since they created those renders and featured them on the boxart and website) was used.
:As for why some characters don't use their renders from the key art, those don't seem to have been released in an isolated form and would need to be cropped from the key art, which would mean a lot of overlap with other characters, and they wouldn't be shown in full. In those cases, a cropped gameplay screenshot generally seems to be showing the characters more completely. I assume once the game gets closer to release, we'll get more renders, and once it's out, we can take more consistent screenshot (i.e. just using the character select screen for everyone, or something).
